https://abini.borbalan.com/en/the-importance-of-regulating-real-estate-agencies-in-the-balearic-islands-a-step-toward-transparency-and-security-in-the-sector/ Mon, 25 Nov 2024 06:36:00 +0000 http://abini.borbalan.com/the-importance-of-regulating-real-estate-agencies-in-the-balearic-islands-a-step-toward-transparency-and-security-in-the-sector/ The real estate sector in the Balearic Islands is fundamental to the local economy, having experienced remarkable growth in terms of regulation and professionalization in recent years. The recent creation of the Official Register of Real Estate Agents of the Balearic Islands (ROAIIB), established by Law 3/2024 on urgent housing measures, represents a significant step towards transparency and security in the sector. This regulation responds to the demands of the Balearic Association of National and International Real Estate Agents (ABINI), whose members have been pioneers in adopting this legislation. The 45 members of ABINI generate employment for over 450 real estate professionals on the islands, highlighting their importance in the labor market.

The Creation of the Official Register of Real Estate Agents

Registration in the ROAIIB is not simply a bureaucratic procedure; it is an essential step toward the professionalization of the real estate sector. This measure requires real estate agents to meet ethical and professional standards, with the aim of protecting consumers and ensuring the quality of services offered. The regulation was introduced in response to the need to combat intrusiveness and fraudulent practices that have historically undermined consumer trust in real estate transactions. With this regulation, a framework is established that not only organizes the sector but also promotes a more professional environment that respects consumer rights.

Advantages for Consumers and Professionals

Registration in the ROAIIB offers numerous advantages for both consumers and real estate agents. Firstly, it ensures that registered agents meet established standards, creating a safer and more trustworthy environment for buyers and sellers. The visibility of the registration number in all agent communications adds a layer of transparency, making it easier to identify accredited professionals.

For market users, this regulation provides greater protection against illegal or fraudulent practices. Additionally, agents are required to have Civil Liability and Surety Insurance policies, which enhance the security of transactions. This is crucial in a market characterized by high demand and the complexity of supply, where stricter control is necessary to prevent abuse and ensure the quality of services.

Consequences of Non-Compliance: Combating Unauthorized Practices

Failure to comply with the registration requirement, as well as the lack of visibility of the registration number in communications, is considered unauthorized practice and may result in significant financial penalties ranging from €3,001 to €30,000. Additionally, offenders may face temporary suspension of their registration or disqualification as real estate agents. This disciplinary approach aims to protect the integrity of the Balearic real estate market and ensure that those operating in this sector adhere to the regulations established for the benefit of consumers.

ABINI: Commitment to Transparency and Professionalization

Since its creation in 2020, ABINI has been a key player in promoting the regulation of the real estate sector in the Balearic Islands. The association has worked closely with the Balearic Government and other entities to ensure the effective implementation of the ROAIIB. According to its president, Hans Lenz, “this registry represents a crucial step forward for the professionalization of the real estate sector in the Balearic Islands and the safety of its users.” This statement underscores ABINI’s commitment to ensuring that its agents meet the necessary standards to protect consumers.

ABINI’s efforts to promote transparency and improve the sector have been fundamental in achieving this legislative milestone. The registration of its 45 members in the ROAIIB reflects a collective effort to raise the quality of real estate services in the Balearic Islands. This commitment translates into greater consumer trust, as they can now rely on real estate agents who operate ethically and professionally.

Recommendation for Users of Real Estate Agencies in the Balearic Islands

From ABINI, we would like to make a call to users of advisory and mediation services in the Balearic Islands. It is important to choose regulated advisors who comply with the law and display their registration number and badge on their website, offices, and advertising. Opting for serious and responsible professionals is a crucial safeguard when making one of the most important decisions in a person’s life: their home.

The Government deepens the real estate chaos in the Balearic Islands with ineffective measures that worsen the housing crisis. https://abini.borbalan.com/en/the-government-deepens-the-real-estate-chaos-in-the-balearic-islands-with-ineffective-measures-that-worsen-the-housing-crisis/ Wed, 16 Oct 2024 23:00:00 +0000 http://abini.borbalan.com/the-government-deepens-the-real-estate-chaos-in-the-balearic-islands-with-ineffective-measures-that-worsen-the-housing-crisis/ From the Balearic Association of National and International Real Estate Agencies (ABINI), we wish to express our deep concern regarding the recent measures proposed by the Government on housing, which continue to exacerbate the problems faced by the real estate sector, especially in the Balearic Islands.

After six years of Pedro Sánchez’s government, the legislative balance in housing matters is bleak. A Land Law that has not materialized and a Housing Law that, far from solving the announced problems, has had adverse effects. These laws have created a more restricted market, raising rental prices and reducing supply. Instead of correcting this dangerous course, the Government proposes new measures that, in the case of the Balearic Islands, will not only be ineffective but are likely to worsen the situation.

Tourist and Seasonal Rental Property Registry: More bureaucracy, less real control

Among the new regulations, the Tourist and Seasonal Rental Property Registry stands out, imposing new bureaucratic burdens on both property owners and intermediaries, requiring them to register each property. While it may seem like a measure intended to regulate the market, in reality, it only adds more administrative complications without providing real solutions.

These measures do not stop temporary rental contracts; instead, they verify them retrospectively. Everyone in the real estate sector knows that this type of regulation only leads to greater legal uncertainty and unnecessary complexity. As Hans Lenz points out, “to this day, the supply of rental properties in the Balearic Islands has fallen by 30%, while prices have increased by 25% since the Housing Law came into effect.” These measures will only continue to cause more non-compliance from property owners and more complications for registry managers.

When a law is enacted, it is essential to ensure its compliance. In the Balearic Islands, effective control over the illegal supply of vacation rentals has not yet been achieved. How can we expect real estate platforms to function any differently from vacation rental platforms? We believe there is no guarantee that these new measures will improve the current situation.

€250 Rental Aid: An Ineffective Solution for Young People in the Balearic Islands

Another controversial measure is the €250 rental aid for young people, which limits access to rentals of up to €600 per month, or €900 if the regional government deems it necessary, or to rooms costing €300. In Palma, there are currently only 10 listings with these characteristics on property search portals.

Furthermore, there are cases of beneficiaries who have taken up to two years to receive the aid. This measure, in its current form, is not realistic in the context of the Balearic market. If the central government does not adjust the parameters of this aid to the reality of prices in the Balearic Islands, it will not only be ineffective but will also increase the frustration of young people trying to access housing in the region.

Real Solutions for the Balearic Islands: Public-Private Collaboration and the Release of Public Land

At ABINI, we believe that the government would do much better to support the urgent approval of the Urgent Housing Measures Law in the Balearic Islands, which puts at risk 4,000 affordable homes for residents. We also urge the Ministries to work on the release of public land in collaboration with the private sector to promote the construction of social and affordable housing.

A clear example of the inefficiency in the management of public land is Son Busquets, which has been neglected for decades due to bureaucracy and remains undeveloped, despite being a project that could alleviate the housing problem in the region. This inaction only demonstrates how the lack of collaboration between administrations has harmed the well-being of residents in the Balearic Islands. “We ask for real collaboration between the central government and the regional government so that this emergency measure and housing for residents can become a reality. Everything else that is being attempted right now to cover up past mistakes will have no positive effect, quite the opposite—more price increases and more non-compliance,” emphasized Lenz.

At ABINI, we insist that the measures proposed by the central government will not solve the problems of the real estate sector in the Balearic Islands. Nor is it expected that a significant number of the 183,000 promised homes will arrive in the Balearic Islands each year. Instead of adding layers of bureaucracy, pragmatic and viable solutions are needed that promote greater collaboration between the public and private sectors, as well as an adaptation of regulations to the local reality. Only in this way can we reverse the current trend of reduced housing supply and the uncontrolled increase in prices.

The debate began with an encouraging message from Lenz: “It is very hard to see between five and eight news stories daily about the housing crisis in the Balearic Islands, today we want to bring clarity and some hope on this issue.” With these words, he opened the discussion table in front of a diverse audience interested in the issue facing the archipelago.

José Francisco Reynés, Director General of Housing and Architecture for the Govern, outlined the main issues exacerbating the housing crisis in the region: the impact of tourism, high production costs, and gentrification. He also presented a thorough analysis and the Govern’s plans to mitigate this situation, including an emergency plan and the construction of approximately 7,000 new homes in the first phase.

Luis Alfonso de León, president of the Official College of Quantity Surveyors and Technical Architects of Mallorca (COAATMCA), emphasized the current impossibility of accessing housing, whether for purchase or rent. “Fifty-seven percent of workers in Spain earn less than 1,000 euros. A person has to allocate 35% of their salary to rent. What can we rent in Mallorca for 350 euros?” De León stated, highlighting the mismatch between citizens’ incomes and market prices.

Hans Lenz also shared his perspective, emphasizing that “housing is the number one problem in the Islands” and called for real solutions beyond the “media noise.” He proposed the creation of subsidies to help young people save, gain access to home ownership, and eventually acquire larger properties in the future. Lenz also highlighted the housing policy being implemented by the Govern regarding rentals: “Providing guarantees to landlords through a secure rental system, ensuring they will be paid, while also giving tenants a discount on the rental price, is not the sole solution but will help ease the tension.”

The debate intensified when De León suggested the possibility of building on rural land as an option to increase the housing supply. However, Bernat Nadal, Dean of the Official College of Architects of the Balearic Islands (COAIB), strongly rejected this idea, stating, “We must not consume more rural land; this is a debate that needs to be put to rest.” Nadal added that patience is required to address the housing issue, as he estimates it will take more than 20 years to overcome.

The debate concluded with a critical statement from Luis Martín, president of the Association of Real Estate Developers of the Balearic Islands (PROINBA), who accused politicians of failing to act with sufficient diligence over the past 15 years to address the housing crisis.

This debate, in which all participants called on authorities to detach housing from any political ideology, highlights the urgency of finding viable solutions for housing access in the Balearic Islands—a matter that profoundly impacts the lives of its residents and demands collaboration from all stakeholders involved.

ABINI (Association of Balearic Real Estate Investors) has criticized Jaume Alzamora and the Més party for their “double standards” in their offensive against tourism and the purchase of housing by foreigners. https://abini.borbalan.com/en/abini-association-of-balearic-real-estate-investors-has-criticized-jaume-alzamora-and-the-mes-party-for-their-double-standards-in-their-offensive-against-tourism-and-the-purchase-of-housing-by-f/ Tue, 10 Sep 2024 23:00:28 +0000 http://abini.borbalan.com/abini-association-of-balearic-real-estate-investors-has-criticized-jaume-alzamora-and-the-mes-party-for-their-double-standards-in-their-offensive-against-tourism-and-the-purchase-of-housing-by-f/ The Balearic Association of National and International Real Estate Agencies (ABINI) has expressed its strongest condemnation of the hypocrisy and deception of voters that has characterized the offensive led by Jaume Alzamora, spokesperson for Més in the Consell de Mallorca, against tourism and the purchase of housing by foreigners. Alzamora, Secretary General of Més per Mallorca, has proposed banning the purchase of real estate by foreigners to curb property speculation, while he himself benefits from such speculation, selling his own home in Artà to a German citizen for €650,000.

This blatant contradiction highlights the double standards of Més per Mallorca and the PSIB-PSOE, who, during the two terms they governed alongside Podemos, launched a campaign against foreign investment in the real estate sector, arguing that this phenomenon was responsible for the housing crisis in the Islands. However, their leaders have shown that they preach one thing and do another—such as in the case of the PSIB-PSOE under Francina Armengol, which sold its headquarters in Alaró to a German citizen for €350,000.

ABINI denounces that, after two terms leading the Balearic Government, Més per Mallorca, Podemos, and the PSIB-PSOE are directly responsible for the severe housing crisis affecting the Islands. They failed to act appropriately to curb the uncontrolled price surge and demonstrated a complete lack of foresight regarding the growing housing demand. Furthermore, their flagship proposal—to limit or ban the sale of properties to foreigners—is not only an impractical utopia but is also disregarded by the very leaders of these parties for their own economic gain. This is likely neither the first nor the last such case to come to light.

Adding to this situation is a new twist in the housing crisis: the warning of unconstitutionality regarding the 4,000 affordable housing units proposed by the government of Pedro Sánchez and Francina Armengol in Madrid. This represents yet another obstacle that further stifles the chances of accessing housing for residents of the Balearic Islands. The citizens of the Balearic Islands cannot remain hostage to such disastrous management.

ABINI will continue to advocate for an open and transparent real estate market, promoting real solutions to improve access to housing. This must include increasing the supply of affordable housing, providing incentives for construction, and improving urban planning, rather than resorting to demagogic and inconsistent measures.

Consensus is key in regulating real estate agents. https://abini.borbalan.com/en/consensus-is-key-in-regulating-real-estate-agents/ Tue, 10 Sep 2024 23:00:08 +0000 http://abini.borbalan.com/consensus-is-key-in-regulating-real-estate-agents/

The Central Government’s challenge primarily concerns the mandatory nature of the Real Estate Agents Registry. This registry was designed as an essential tool to ensure that those engaged in real estate brokerage operate within a framework of transparency and professionalism. The requirement to be registered should not be seen as a restriction on the practice of the profession but rather as a protective measure for both consumers and agents themselves.

In fact, the aim of this regulation is not to limit the entry of professionals into the market, but to ensure that those who act in it do so with the appropriate knowledge and training. As established in the law, real estate agents must comply with a series of training requirements that allow them to offer a service that guarantees legal security in transactions, correct information on properties and, above all, consumer protection. In a real estate market as complex as the Balearic one, where access to housing is one of the great challenges of our society, the regulation and professionalization of intermediaries is more necessary than ever.

It is important to remember that this regulation was the result of a consensus between the PP and the PSIB-PSOE, agreed during the amendment phase of the processing of the law in Parliament. The fact that it has been promoted by both parties shows that we are not talking about a partisan or ideological proposal, but a measure of general interest that seeks to improve the quality of the real estate market in the Balearic Islands. The creation of the registry, therefore, is not a mere bureaucratic formality, but a response to the need to increase transparency and security in a sector that handles large volumes of money and directly affects the lives of citizens.

The Sanchez government’s questioning of whether this registry is compatible with state law is, to say the least, worrying. Real estate brokerage responds to a general interest that affects both public safety and consumer protection. The real estate market of the Balearic Islands has unique characteristics, and not all national regulations respond to the particularities of our islands. It is essential that the commission created between both administrations takes into account these specificities and does not delay the implementation of a regulation that has already been debated, negotiated and approved.

A prolonged delay in the implementation of these measures could have serious consequences. We are talking about a possible paralysis of investments in the sector, a blow that the islands cannot afford. We cannot forget that access to housing is one of the most pressing problems in our community, and any measure that contributes to easing the market, protecting consumers and guaranteeing a safer environment for transactions must be implemented as quickly as possible.

From ABINI, we are confident that the Government and the Central Government will reach an agreement that will allow progress in the regulation of the real estate sector. It is necessary for the Bilateral Commission to be agile and efficient in its negotiations so as not to harm either consumers or real estate agents. Uncertainty is not an option. It is vital that the necessary measures are put in place as soon as possible so that the market can continue to function optimally and the citizens of the Balearic Islands have access to a safer, more transparent and fairer real estate market.

ABINI calls for doubling the budget for social and affordable housing for residents in the Balearic Islands https://abini.borbalan.com/en/abini-calls-for-doubling-the-budget-for-social-and-affordable-housing-for-residents-in-the-balearic-islands/ Fri, 30 Aug 2024 10:26:20 +0000 http://abini.borbalan.com/abini-calls-for-doubling-the-budget-for-social-and-affordable-housing-for-residents-in-the-balearic-islands/ The Balearic Association of National and International Real Estate (ABINI) has urged the Balearic Government to double the budget for social housing and to expand it to include affordable housing for residents in the Balearic Islands. The Association stresses that the average investment of 0.7% during the Pacte stage was clearly insufficient and proposes that it should work with 3% of the budget to bring the Balearics out of the European queue in social housing. “Social housing and ambitious affordable housing schemes are a fundamental part of the residential fabric needed for a healthy housing market,” said Hans Lenz, president of ABINI. “It is imperative that significant financial provision is made in these sectors to ensure that residents in the Balearic Islands have access to decent housing.” In addition, ABINI has expressed its concern over the unconstitutionality warnings launched by the Central Government against the Law of Urgent Measures in Housing, as this puts the Balearic affordable housing project at risk. “This law is vital to depressurize the real estate market and offer real solutions to island residents,” added Lenz. “The modifications proposed by the Central Government could mean a delay of more than ten years in its implementation. In addition, unconstitutionality notices are already paralyzing investment, which is creating immediate problems on the ground.” ABINI calls for urgent awareness of the enormous housing problem facing the citizens of the Balearic Islands and requests that the Bilateral Commission between the Balearic Government and the Central Government be agile, quick and reasonable in its negotiations, prioritizing the welfare of the residents of the Balearic Islands. On the other hand, ABINI will continue to follow the development process of the registry and the new regulations applicable to real estate agents in the Balearic Islands.
